This policy applies exclusively to the lms.progideo.com website, operated by the company “Progideo SARL”. This policy does not apply to any other website or service operated by Progideo SARL.

Progideo SARL is a Moroccan corporation registered in Casablanca under number 234883. Our offices are located at 147 rue Mohamed Smiha, 20000 Casablanca, Morocco. Progideo SARL is a company that specializes in IT services and particularly in software testing.

Article 1 - Purpose

This policy defines the rules of use, the rights and responsibilities of the parties involved and the terms and conditions of the lms.progideo.com website.

Article 2 - Privacy

To use the services provided by the lms.progideo.com website, a personal account must be created by each user. In accordance with Moroccan law 09-08 related to the protection of personal data, all personal information kept by the lms.progideo.com website may be searched for, modified and deleted by the person concerned. Changes to this information may be made directly on the lms.progideo.com website or by physical mail, with proof of identity, to the following address:

The lms.progideo.com website does not store any information concerning the payment methods used. Payments for the services provided by this website can be made through PayPal or through direct payments to Progideo SARL. In both cases, the means of payment are not recorded on the lms.progideo.com website.

The personal data provided to Progideo SARL through the lms.progideo.com website will not be transferred or sold to any third party without the client's prior consent.

Unless stated otherwise, all materials on the lms.progideo.com website are the exclusive property of Progideo SARL. This material cannot be copied or distributed, partially or totally, without the consent of Progideo SARL, under threat of prosecution for violation of intellectual property.

Article 3 - Prices

Prices of services and training available through the lms.progideo.com website are quoted in euros (EUR) and in Moroccan dirhams (MAD), all taxes included.

Article 4 - Orders

Orders can be placed directly on the lms.progideo.com website or by email at contact@progideo.com.

An order is considered firm and final after its full payment, whatever the means of payment. After the payment is completed, an order confirmation is sent to the user by email and immediate access is granted to the service or training.

Once paid, an order is final and irrevocable. It cannot be cancelled, refunded or changed, except in case of formal agreement by Progideo SARL.

When an order is made, the client is informed of the rules defining the terms and conditions of the sale. By validating the order, the client therefore agrees to these terms of sale.

Article 5 - Payment

Payments can be made using PayPal or by a bank transfer to Progideo SARL. In the case of a bank transfer, the payment will be accepted once it is duly recorded on the bank account of Progideo SARL. The bank transfer must be made to the following account: BMCI MACA 013780 01074 00069100146 48. The description of the bank transfer should include the lms.progideo.com username of the person benefiting from the service or training.

Article 6 - Non-execution of the order

In accordance with article 40 of Moroccan law 31-08, in the event in which the contract cannot be executed as a result of the unavailability of the service ordered, Progideo SARL will promptly inform the client of the situation. Progideo SARL will then provide a credit to be used on a future order or will refund the client within fifteen days (15 days) of payment.

Progideo SARL cannot be held liable for a breach of contract in case of force majeure, flood, fire, disruption of services, total or partial strike, in particular related to the communication services (such as data network services) and to the IT services (such as the servers provided by third parties).

Progideo SARL cannot be held liable to a customer or third party for any indirect damage, any loss of profit or revenue and any loss of data that may have occurred in any manner whatsoever, even if this damage, loss or prejudice was foreseeable by Progideo SARL, and even if such a possibility had been brought to the attention of Progideo SARL.

Article 7 - Invoicing

After the payment has been accepted, the invoice for the purchase will be sent by email to the customer having placed the order, using the email address provided by the user.

Article 8 - Validity

Progideo SARL reserves the right to change this policy at any time. Any new version of the policy will be posted on the lms.progideo.com website.

Article 9 - Disputes

All claims must be sent by email to contact@progideo.com.

Any dispute arising between the parties regarding the conclusion, execution, interpretation and / or breach of this policy for any reason whatsoever, and for which an amicable settlement could not be found, will be submitted to the competent arbitration tribunal. This policy is governed by Moroccan law.
